Buying, building and managing property in Pakistan from the USA

This guide is for Pakistani families in the United States who want to buy a plot or house in Lahore, build on land they already own, rent out a family home, or sell an inherited property.

The hurdles are familiar: you are 9 to 13 hours behind Lahore, documents must be signed before a Pakistan consulate, fraudsters target owners who live abroad, and every visit costs leave and airfare.

Houseplot's Lahore team does the ground work (checks, site videos, transfers, construction, tenants, paperwork) while you keep control of every decision and payment.

  3. Verify before paying. We check title, society approval, dues and the seller's identity, and give you a live video walk-through.
  4. Choose your attorney. A trusted person in Pakistan who signs for you.
  5. Execute a power of attorney in the USA. Through your Pakistan consulate or the NADRA online system (see below).
  6. Arrange funds. Use a Roshan Digital Account or regular banking channels. Keep every proof of remittance.
  7. Sign the sale agreement. Your attorney signs in Lahore; you review the draft first.
  8. Pay taxes and fees. FBR advance tax and transfer charges (see Taxes below).
  9. Complete the transfer. Registry, intiqal or society transfer in your name; we confirm the new record shows you as owner.
  10. Take possession. We record the handover, change locks and set up utilities in your name.

Documents you need

Document Why it is needed
NICOP or CNIC Identity for transfers, POA and the FBR overseas filer-rate route
Pakistan Origin Card (POC) For US citizens of Pakistani origin who no longer hold a Pakistani ID
Pakistani or US passport Identity at the consulate; proof of stay abroad
Attorney's CNIC copy Required on the POA
Passport-size photographs Pasted on the POA at the consulate
Proof of remittance Bank records showing money came through official channels
Property papers Title documents, society allotment/transfer letters, approved maps
Witness details Many POA formats require two witnesses with ID details

The Los Angeles consulate says an executant without a Pakistani ID must first have documents such as a POA attested by the US Department of State before consular attestation (Consulate General of Pakistan, Los Angeles).

Power of attorney from the USA

A power of attorney (general or special) lets someone in Pakistan buy, sell or manage property for you. There are three routes to make a US-signed POA usable in Pakistan.

1. Attestation at a Pakistan mission (most common). The person giving the power signs in front of a consular officer. The Los Angeles consulate requires the executant to appear in person with an original valid passport or NICOP, no longer accepts POAs by mail, and lists a fee of $36 per document, payable by postal money order or cashier's check (Consulate General of Pakistan, Los Angeles). Other missions set their own procedures and fees, so check yours.

2. NADRA online POA. Pakistan missions also link to NADRA's online power of attorney portal, poa.nadra.gov.pk (Pakistan Consulate Los Angeles). You apply online with executant, attorney and witness details; after NADRA verification the mission holds an online interview and issues a receipt, which you send to your attorney with the signed document (High Commission for Pakistan, London). Confirm current eligibility and steps with your consulate before you start.

3. Apostille. Pakistan joined the Hague Apostille Convention, which entered into force for Pakistan on 9 March 2023; for the United States it has been in force since 15 October 1981 (HCCH status table). Pakistan's Ministry of Foreign Affairs says apostilles from member states are accepted "without any requirement of attestation from Ministry of Foreign Affairs or Pakistan Missions abroad" (MOFA Pakistan). Some registrars and housing societies in Lahore still expect a consulate- or NADRA-attested POA for property, so ask the receiving office which form it accepts before you choose this route.

Pakistan missions in the USA

Go to the mission that covers your state (MOFA Pakistan, Washington):

  • Embassy, Washington, D.C. — D.C., Maryland, Virginia, West Virginia, North Carolina, South Carolina, Pennsylvania, Tennessee
  • Consulate General, New York — New York, New Jersey, Connecticut, Massachusetts, Rhode Island, Maine, New Hampshire, Vermont, Delaware, Kentucky, Wyoming
  • Consulate General, Chicago — Illinois, Michigan, Ohio, Indiana, Wisconsin, Minnesota, Iowa, Missouri, Kansas, Nebraska, North Dakota, South Dakota
  • Consulate General, Houston — Texas, Florida, Georgia, Louisiana, Alabama, Mississippi, Arkansas, Oklahoma, Colorado, New Mexico
  • Consulate General, Los Angeles — California, Nevada, Arizona, Utah, Idaho, Oregon, Washington, Hawaii, Alaska, Montana

Using the POA in Pakistan

Your attorney presents the original attested POA to the office handling the deal: the sub-registrar or Punjab Land Records service centre for registry and mutation, or the housing society or development authority for society transfers. Offices may verify it, require registration or insist on their own format, so check first, and draft the POA for the specific property and powers needed rather than giving unlimited general powers.

Sending money for property

Roshan Digital Account (RDA). This is a State Bank of Pakistan initiative. Non-resident Pakistanis with a CNIC or NICOP, and foreigners holding a POC, can open one, and funds can go into SBP-permitted investments including "residential and commercial real estate investments." Money can be sent back abroad up to the account balance without approval from the bank or SBP (RDA FAQs, Embassy of Pakistan Sweden).

Roshan Apna Ghar. Under this SBP scheme, RDA holders can buy, build or renovate a home in Pakistan using their own funds or bank financing, with the process done remotely, and SBP states the investment is fully repatriable (SBP press release, 27 Aug 2021). Terms change, so confirm current rates and eligibility with a participating bank.

Regular banking channels. You can also send money through normal bank transfers to your own account in Pakistan, then pay the seller by bank instrument.

Whatever route you use:

  • Keep proof of every inward remittance (bank statements, remittance certificates).
  • Never pay a seller in cash or into a third party's account.
  • Avoid hawala and hundi: no legal trail, and no way to prove the source of funds later.

Taxes to know

Pakistan side. On property transfers, FBR collects advance tax from the buyer under section 236K and from the seller under section 236C. Rates differ for filers, late filers and non-filers, and the slabs have been revised in recent Finance Acts, so check FBR's current withholding tax rate card before you budget.

FBR allows overseas Pakistanis who hold a NICOP or POC and are non-resident (in Pakistan for less than 183 days in the tax year) to pay the filer rate even if they have not filed a return. The registrar or society creates a payment slip (PSID) through the "Overseas Pakistanis" link on the FBR portal; you declare your NICOP/POC and residency status, the Commissioner approves it, and you pay at the filer rate (FBR Overseas FAQs). Separately, if you are on the Active Taxpayer List, you are treated as a filer.

Punjab stamp duty, registration fee and other provincial charges also apply.

US side. Rent from a Lahore property, and any gain when you sell, may also need to be reported to the IRS, and money held in Pakistani bank accounts may have its own reporting rules. Speak to a US tax adviser who understands foreign property before you buy, not after.

Building or renovating from the USA

Building from the other side of the world works when the process is structured:

  1. Design. An architect prepares plans for your approval.
  2. Approvals. Plans are approved by the society or development authority before work starts.
  3. Contractor. Quotes on one specification, past-work checks and a written contract with a schedule.
  4. Staged payments. Pay by milestone (foundation, grey structure, finishing), never the whole amount upfront.
  5. Updates. Weekly photos and videos, plus live video calls timed for your evening.
  6. Quality checks. Material checks and inspections at each stage before the next payment is released.
  7. Handover. Snag list, completion documents and utility connections.

Renting out and property management

  • Tenant finding. Advertising, viewings and checking the tenant's ID, job and references.
  • Rent agreement. A written agreement under the Punjab Rented Premises Act 2009, covering rent, deposit, term and maintenance.
  • Police registration. The Punjab Information of Temporary Residents Act 2015 requires owners, tenants and property dealers to share tenant details with the local police. This can be done online through trs.punjabpolice.gov.pk or at a police station or Khidmat Markaz, with CNIC copies, photographs and the rent agreement (Punjab Police).
  • Rent collection. Paid into your bank account, with monthly statements.
  • Maintenance and inspections. Repairs, periodic inspection visits with photos.
  • Utility bills. Checking that electricity, gas and water bills are paid and no arrears build up.
  • Statements. A regular report of income, expenses and property condition.

Selling and sending the money back

  1. Get a valuation based on recent deals and clear any dues.
  2. Screen buyers and accept payment only by bank instrument.
  3. You or your attorney sign the transfer; the seller pays 236C advance tax.
  4. Funds land in your Pakistani account.

If the property was bought through a Roshan Digital Account, SBP says the investment is fully repatriable, and an earlier SBP release says the principal can be sent abroad on sale without special permission (SBP, 27 Aug 2021; SBP, 25 Aug 2021). For property bought by other routes, ask your bank what documents it needs to send the money to the USA, and keep your original remittance proofs.

Avoiding fraud from abroad

Red flags overseas buyers in the USA should watch for:

  • A seller who pushes you to pay token money before any document check.
  • Prices well below the market "because the owner is also abroad."
  • A request to pay into a personal account that is not the owner's.
  • Files or plots in societies whose approval you cannot confirm.
  • Photos only, with excuses for why a live video is not possible.
  • A relative or caretaker asking for a broad general POA "just in case."

Give your attorney limited, property-specific powers, cancel old POAs you no longer need, and check land records yourself from time to time.

Disputes, inheritance and help

  • Overseas Pakistanis Commission (OPC) Punjab. Handles complaints from overseas Pakistanis, including illegal occupation. Complaints can be lodged via opc.punjab.gov.pk; in one case, the District Overseas Pakistanis Committee Lahore got a US-based owner's plot in Shalimar Town vacated from grabbers (Government of Punjab).
  • Overseas Pakistanis Foundation (OPF). Its complaint cell handles "property disputes or illegal occupation" and refers matters to authorities. You can complain online through opf.pitb.gov.pk, by phone on UAN +92 51 111 040 040, through Pakistan missions abroad or the Pakistan Citizen's Portal. OPF notes you may still need to file a court case yourself (OPF Complaint Cell).
  • Succession certificates. NADRA issues succession certificates and letters of administration; legal heirs abroad can give biometrics at Pakistani missions (APP). The Houston consulate's NADRA desk lists succession certificate biometrics free of charge, for applications initiated in Pakistan (Pakistan Consulate Houston).

Best time to talk

Pakistan Standard Time is UTC+5 and does not change for daylight saving. Most of the US moves its clocks forward in March and back in early November, so the gap changes twice a year.

US time zone Pakistan is ahead by (summer, DST) Pakistan is ahead by (winter)
Eastern (New York, Atlanta) 9 hours 10 hours
Central (Chicago, Houston) 10 hours 11 hours
Mountain (Denver) 11 hours 12 hours
Pacific (Los Angeles, Seattle) 12 hours 13 hours

Lahore's working day starts around midnight on the US East Coast, so we book consultations in your evenings and on weekends.

FAQs

Can I buy property in Lahore while living in the USA without travelling? Yes. With a power of attorney attested at your Pakistan mission (or through NADRA's online POA), a trusted attorney in Lahore can sign for you, and you can pay through your bank.

I am a US citizen and my Pakistani ID has expired. What should I do? Get a NICOP renewed or apply for a POC through NADRA. Without a Pakistani ID, the Los Angeles consulate says documents like a POA need prior attestation by the US Department of State.

Can I use an apostille instead of going to the consulate? Both countries are parties to the Apostille Convention, and MOFA Pakistan says apostilled documents need no further mission attestation. But confirm with the registrar or society in Lahore that it accepts an apostilled POA for property before relying on it.

Do I pay non-filer tax if I have never filed in Pakistan? Not necessarily. Non-resident NICOP or POC holders can use FBR's overseas PSID route to pay at the filer rate.

Can I use a Roshan Digital Account from the USA to buy property? Yes. RDA funds can be invested in residential and commercial real estate, and Roshan Apna Ghar offers financing for buying or building a home.

Will I owe US tax on rent from Lahore? Possibly. Ask a US tax adviser how the IRS treats your Pakistani rental income and gains.

This page is general information; confirm legal and tax steps with the relevant authority or a qualified adviser before you act.
